11 The Committee on Governmental Operations (Lawson) recommended
12 the following amendment:

15 On page 26, line 6, through page 27, line 8, delete
16 those lines
17
18 and insert:
19 and the spiny lobster endorsement trap number issued under
20 pursuant to s. 370.14(2) or (6) may be suspended for the
21 remainder of the current license year. For all other first
22 violations, the commission shall assess an additional
23 administrative penalty of up to $500.
24 b. For a second violation of subparagraph 1. or
25 subparagraph 2. which occurs within 24 months of any previous
26 such violation, the commission shall assess an additional
27 administrative penalty of up to $2,000 and the spiny lobster
28 endorsement trap number issued under pursuant to s. 370.14(2)
29 or (6) may be suspended for the remainder of the current
30 license year.

1 1., subparagraph 2., or subparagraph 3. which occurs within 36
2 months of any previous two such violations, the commission
3 shall assess an additional administrative penalty of up to
4 $5,000 and may suspend the spiny lobster endorsement trap
5 number issued under pursuant to s. 370.14(2) or (6) for a
6 period of up to 24 months or may revoke the spiny lobster
7 endorsement trap number and, if revoking the spiny lobster
8 endorsement trap number, may also proceed against the
9 licenseholder's saltwater products license in accordance with
10 the provisions of s. 370.021(2)(h).
11 d. Any person assessed an additional administrative
12 penalty pursuant to this section shall within 30 calendar days
13 after notification:
14 (I) Pay the administrative penalty to the commission;
15 or
16 (II) Request an administrative hearing pursuant to the
17 provisions of ss. 120.569 and 120.57.
18 e. The commission shall suspend the spiny lobster
19 endorsement trap number issued pursuant to s. 370.14(2) or (6)
20 for any person failing to comply with the provisions of
21 sub-subparagraph d.
