  1                      A bill to be entitled

  2         An act relating to the Tohopekaliga Water

  3         Authority, Osceola County; amending chapter

  4         2003-368, Laws of Florida; providing for

  5         additional board members to be appointed

  6         pursuant to an interlocal agreement with the

  7         authority; providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (1) of section 6 of chapter

12  2003-368, Laws of Florida, is amended to read:

13         Section 6.  Governing Body.

14         (1)  The governing body of the Authority shall consist

15  of five permanent members and one or more interlocal members,

16  as may be appointed, acting as the Board of Supervisors, each

17  of whom shall serve a term of 3 years commencing on October 1,

18  provided the procedure for appointment of members of the Board

19  of Supervisors and their initial terms of office shall be as

20  follows:

21         (a)  Board Supervisor No. 1 and Board Supervisor No. 2

22  shall serve for initial terms of approximately 2 years, ending

23  on September 30, 2005. Board Supervisor No. 1 shall be

24  appointed by the Osceola County Board of County Commissioners.

25  Board Supervisor No. 2 shall be appointed by the City

26  Commission of the City of Kissimmee.

27         (b)  Board Supervisor No. 3 and Board Supervisor No. 4

28  shall serve initial terms of approximately 3 years, ending on

29  September 30, 2006. Board Supervisor No. 3 shall be appointed

30  by the Osceola Board of County Commissioners. Board Supervisor

 1  No. 4 shall be appointed by the City Commission of the City of

 2  Kissimmee.

 3         (c)  Board Supervisor No. 5 shall serve an initial term

 4  of approximately 4 years, ending September 30, 2007. Board

 5  Supervisor No. 5 shall be collectively appointed by joint

 6  resolution of the Osceola County Board of County Commissioners

 7  and the City Commission of the City of Kissimmee and shall

 8  serve as the Chairperson of the Board of Supervisors.

 9         (d)  By resolution, one additional Board Supervisor may

10  be appointed by each additional general-purpose local

11  government that has adopted a resolution authorizing the

12  Authority to provide services and facilities within a service

13  area within its boundaries and that has entered into an

14  interlocal agreement with the Authority authorizing the

15  Authority to provide its potable or nonpotable water or

16  wastewater management or delivery services or programs to

17  retail customers within such service area, provided such

18  interlocal agreement expressly provides for the appointment of

19  such interlocal member of the Board of Supervisors. Such

20  appointment shall be effective only for so long as the

21  interlocal agreement is effective. Any interlocal member

22  appointed to the Board of Supervisors shall serve an initial

23  term of not more than 3 years, ending on September 30 of the

24  final year of the term.

25         Section 2.  This act shall take effect upon becoming a

26  law.
