13 Senate Amendment (with title amendment)
14 On page 1, line 20, through
15 page 2, line 3, delete those lines
16
17 and insert:
18 (1) A No parent, legal guardian, or other person
19 responsible for a child younger than 6 years of age may not
20 shall leave such child unattended or unsupervised in a motor
21 vehicle:
22 (a) For a period in excess of 15 minutes; however, no
23 such person shall leave a child unattended
24 (b) For any period of time if the motor of the vehicle
25 is running; or
26 (c) For any period of time if the health of the child
27 is in danger.
28 (2) Any person who violates the provisions of
29 subsections (1)(a) commits a misdemeanor of the second degree
30 punishable as provided in s.775.082 or s.775.083. is guilty
31 of a noncriminal traffic infraction, punishable by a fine

1 of: (a) Not more than $100; or
2 (3) Any person who violates the provisions of
3 subsection (1)(b) or (1)(c) is guilty of a noncriminal traffic
4 infraction, punishable by a fine(b)not less than $50 and not
5 more than $500.
6 (4)(3) Any law enforcement officer who observes a
7 child left unattended or unsupervised in a motor vehicle in
8 violation of subsection (1) may use whatever means are
9 reasonably necessary to protect the minor child and to remove
10 the child from the vehicle.
11 (5)(4) If the child is removed from the immediate area
12 notification should be placed on the vehicle.
13 (6)(5) The child shall be remanded to the custody of
14 the Department of Children and Family Services pursuant to
15 chapter 39, unless the law enforcement officer is able to
16 locate the parents or legal guardian or other person
17 responsible for the child
