11  Senator Baker moved the following amendment:
12  
13         Senate Amendment (with title amendment) 
14         On page 1, line 27, through
15            page 2, line 16, delete those lines
16  
17  and insert:  
18         (2)  Any person who violates the provisions of
19  subsection (1) commits is guilty of a noncriminal traffic
20  infraction, punishable by a fine of:
21         (a)  Not more than $200 $100; or
22         (b)  Not less than $100 $50 and not more than $500 if
23  the motor of the vehicle was running or the health of the
24  child was in danger at the time of the violation.
25         (3)  Any law enforcement officer who observes a child
26  left unattended or unsupervised in a motor vehicle in
27  violation of subsection (1) may use whatever means are
28  reasonably necessary to protect the minor child and to remove
29  the child from the vehicle.
30         (4)  If the child is removed from the immediate area,
31  notification should be placed on the vehicle.
