1 A bill to be entitled
2 An act relating to sand source management;
3 creating s. 161.144, F.S.; providing for the
4 development and maintenance of an inventory of
5 identified offshore sand sources by the
6 Department of Environmental Protection as part
7 of its comprehensive long-term beach management
8 plan; providing for public review of maps of
9 offshore sand sources; providing for boards of
10 county commissioners of coastal counties
11 adjacent to sand sources proposed for use
12 outside of the region or subregion to be
13 notified and given adequate opportunity to
14 comment during a project's planning and
15 permitting stages; providing for the inclusion
16 of certain information in the department's
17 annual funding request; providing an effective
18 date.

20 Be It Enacted by the Legislature of the State of Florida:

22 Section 1. Section 161.144, Florida Statutes, is
23 created to read:
24 161.144 Policy guidance related to sand source
25 management.--The Legislature recognizes that beach-quality
26 sand for the nourishment of the state's critically eroded
27 beaches is an exhaustible resource, in ever-decreasing supply,
28 and must be carefully managed for the systemwide benefit of
29 the state's beaches. Therefore, the Department of
30 Environmental Protection, pursuant to s. 161.161 and in
31 cooperation with federal and local government agencies, shall

1 develop and maintain an inventory of identified offshore sand
2 sources as part of the regional elements of its comprehensive
3 long-term beach management plan. Offshore sand sources in
4 state or federal waters which are identified for potential,
5 proposed, or permitted use shall be clearly mapped or
6 otherwise noted and readily available for public review. In
7 addition, boards of county commissioners of coastal counties
8 adjacent to sand sources proposed for use outside of the
9 region or subregion shall be provided written notice by the
10 department and an opportunity to comment during a specific
11 project's planning and permitting stages. The department shall
12 identify in its annual list of local government funding
13 requests submitted to the Legislature, pursuant to s. 161.091,
14 those projects that propose to use sand sources from another
15 region or subregion at the time the list is submitted.
16 Section 2. This act shall take effect October 1, 2007.

18 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
19 Senate Bill 2008

21 The committee substitute clarifies that the Department of
Environmental Preservation has responsibility for notifying
22 local governments of certain proposed renourishment projects
and that the department includes in their annual submission
23 information regarding those projects which propose to use sand
from outside their region or subregion.
