15 page 4, line 17, delete those lines

17 and insert:
18 (1) Pharmacists who hold a doctor of pharmacy degree
19 may administer influenza virus immunizations to adults within
20 the framework of an established protocol under a supervisory
21 practitioner who is a physician licensed under chapter 458 or
22 chapter 459 or by written agreement with a county health
23 department. Each protocol shall contain specific procedures
24 for addressing any unforeseen allergic reaction to influenza
25 virus immunizations.
26 (2) A pharmacist may not enter into a protocol unless
27 he or she maintains at least $200,000 of professional
28 liability insurance and has completed training in influenza
29 virus immunizations as provided in this section.
30 (3) A pharmacist administering influenza virus
31 immunizations shall maintain and make available patient

1 records using the same standards for confidentiality and
2 maintenance of such records as those that are imposed on
3 health care practitioners under s. 456.057. These records
4 shall be maintained for a minimum of 5 years.
5 (4) The decision by a supervisory practitioner to
6 enter into a protocol under this section is a professional
7 decision on the part of the practitioner and a person may not
8 interfere with a supervisory practitioner's decision as to
9 entering into such a protocol. A pharmacist may not enter into
10 a protocol that is to be performed while acting as an employee
11 without the written approval of the owner of the pharmacy.
12 Pharmacists shall forward immunization records to the
13 department for inclusion in the state registry of immunization
14 information.
15 (5) Any pharmacist seeking to administer influenza
16 virus immunizations to adults under this section must be
17 certified to administer influenza virus immunizations pursuant
18 to a certification program approved by the Board of Pharmacy
19 in consultation with the Board of Medicine and the Board of
20 Osteopathic Medicine. The certification program shall, at a
21 minimum, require that the pharmacist attend at least 20
22 semester hours of continuing education classes approved by the
23 Board of Medicine. The program shall have a curriculum of
24 instruction concerning the safe and effective administration
25 of influenza virus immunizations, including, but not limited
26 to, potential allergic reactions to influenza virus
27 immunizations.
