1 A bill to be entitled
2 An act relating to trust funds; creating the
3 Florida Alternative Energy Center Trust Fund;
4 providing for sources of funds and purposes;
5 requiring funds to remain in the trust fund at
6 the end of each fiscal year; providing for
7 future review and termination or re-creation of
8 the fund; providing a contingent effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. (1) The Florida Alternative Energy Center
14 Trust Fund is created within, and shall be administered by,
15 the Office of Tourism, Trade, and Economic Development. Moneys
16 deposited into the fund shall be those collected from sources
17 designated by law, federal moneys made available for
18 alternative energy uses, donations, or moneys appropriated
19 from the General Revenue Fund. The purpose of the trust fund
20 is to provide funding for the Florida Alternative Energy
21 Center in fulfilling its statutory duties.
22 (2) Notwithstanding s. 216.301, Florida Statutes, and
23 under s. 216.351, Florida Statutes, any balance in the trust
24 fund at the end of any fiscal year shall remain in the trust
25 fund at the end of the fiscal year and shall be available for
26 carrying out the purposes of the trust fund.
27 (3) In accordance with Section 19(f)(2), Article III
28 of the State Constitution, the trust fund must, unless
29 terminated sooner, be terminated on July 1, 2011. Before its
30 scheduled termination, the trust fund must be reviewed as
31 provided in s. 215.3206(1) and (2), Florida Statutes.

1 Section 2. This act shall take effect on the same date
2 as SB 996 or similar legislation takes effect, if such
3 legislation is enacted in the same legislative session, or an
4 extension thereof, and becomes law, but this act shall not
5 take effect unless it is enacted by a three-fifths vote of the
6 membership of each house of the Legislature.

11 Committee Substitute for Senate Bill 2026 provides for
administration of the trust fund by the Office of Tourism,
12 Trade, and Economic Development instead of the Public Service
Commission, changes the name of the
13 alternative-energy-development entity, and specifies that the
bill is tied to SB 996.
