11  The Committee on Children, Families, and Elder Affairs (Rich)
12  recommended the following amendment:

14         Senate Amendment 
15         On page 50, lines 4-15, delete those lines
16  
17  and insert:  having legal custody has abandoned the child in
18  accordance with the definition contained in s. 63.032(1). A
19  finding of abandonment may be based upon emotional abuse or a
20  refusal to provide reasonable financial support, when able, to
21  a birth mother during her pregnancy. If, in the opinion of the
22  court, the efforts of a parent or person having legal custody
23  of the child to support and communicate with the child are
24  only marginal efforts that do not evince a settled purpose to
25  assume all parental duties, the court may declare the child to
26  be abandoned. In making this decision, the court may consider
27  the conduct of a father toward the child's mother during her
28  pregnancy.
