  1                      A bill to be entitled

  2         An act relating to inmate death notification;

  3         amending s. 944.09, F.S.; requiring the

  4         Department of Corrections to adopt procedures

  5         for providing notice of the death of an inmate

  6         in the state correctional system; prescribing

  7         written information to be provided to the

  8         person designated by the inmate to receive

  9         notice of the inmate's death; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Paragraph (s) is added to subsection (1) of

15  section 944.09, Florida Statutes, to read:

16         944.09  Rules of the department; offenders,

17  probationers, and parolees.--

18         (1)  The department has authority to adopt rules

19  pursuant to ss. 120.536(1) and 120.54 to implement its

20  statutory authority. The rules must include rules relating to:

21         (s)  Notice of the death of an inmate. The rules must

22  require the correctional facility in which an inmate died to:

23         1.  Notify the person designated by the inmate to

24  receive notice of the inmate's death; and

25         2.  Provide, in writing, to the person designated by

26  the inmate to receive notice of the inmate's death information

27  that will assist the person in contacting the department

28  concerning matters relating to the death of the inmate.

29         Section 2.  This act shall take effect July 1, 2007.

 4  Clarifies that the Department of Corrections is required to
    provide the person who is designated by an inmate to be
 5  notified of the inmate's death with written information of how
    to contact the department regarding questions relating to the
 6  death.
