  1                      A bill to be entitled

  2         An act relating to Florida educational

  3         specialty license plates; amending s.

  4         320.08058, F.S.; authorizing the use of up to

  5         10 percent of proceeds from such plates for

  6         marketing and promotion expenses; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (8) of section 320.08058,

12  Florida Statutes, is amended to read:

13         320.08058  Specialty license plates.--

14         (8)  FLORIDA EDUCATIONAL LICENSE PLATES.--

15         (a)  The Department of Highway Safety and Motor

16  Vehicles shall develop a Florida educational license plate as

17  provided in this section.  Florida educational license plates

18  must bear a design and colors that the department approves.

19  The word "Florida" must appear in small letters at the top of

20  the plate.

21         (b)  The license annual use fees are to be distributed

22  annually as follows:

23         1.  Up to 10 percent of the moneys raised from the sale

24  of the plates may be used for continuing marketing and

25  promotion of the plates.

26         2.1.  In each school district that has a district

27  prekindergarten through grade 12 public school foundation or a

28  direct-support organization, the moneys raised in that school

29  district through the sale of Florida educational license

30  plates must be distributed to the foundation or organization

31  for enhancing educational programs.

 1         3.2.  In each school district that does not have a

 2  district prekindergarten through grade 12 public school

 3  foundation or a direct-support organization, the moneys raised

 4  in that school district through the sale of Florida

 5  educational license plates must be distributed to the district

 6  school board and must be used at the discretion of the board

 7  for enhancing educational programs.

 8         Section 2.  This act shall take effect July 1, 2007.
