11 Senator Bennett moved the following amendment:

13 Senate Amendment (with title amendment)
14 On page 16, between lines 3 and 4,

16 insert:
17 Section 16. The Office of Insurance Regulation shall
18 conduct a review of Medicare Advantage plans, including
19 private fee-for-service plans (PFFS), operating in this state
20 under contract with the United States Centers for Medicare and
21 Medicaid Services, to determine the deference, if any, granted
22 to the state by federal authorities to apply ss. 624.4095 and
23 624.4085, Florida Statutes, to solvent PFFS plans pursuant to
24 the Medicare Modernization Act of 2003, in particular 42
25 U.S.C. s. 1395W-26(b)(3) and applicable rule 42 C.F.R. s.
26 422.402. A report that evaluates the applicability of these
27 statutes to Medicare Advantage plans shall be prepared and
28 submitted to the Financial Services Commission, the President
29 of the Senate, and the Speaker of the House of Representatives
30 by January 1, 2008.
