| 7 |      Section 2.  Paragraph (f) of subsection (4) of section  | 
| 8 | 1001.42, Florida Statutes, is amended to read: | 
| 9 |      1001.42  Powers and duties of district school board.--The  | 
| 10 | district school board, acting as a board, shall exercise all  | 
| 11 | powers and perform all duties listed below: | 
| 12 |      (4)  ESTABLISHMENT, ORGANIZATION, AND OPERATION OF  | 
| 13 | SCHOOLS.--Adopt and provide for the execution of plans for the  | 
| 14 | establishment, organization, and operation of the schools of the  | 
| 15 | district, including, but not limited to, the following: | 
| 16 |      (f)  Opening and closing of schools; fixing uniform  | 
| 17 | date.--Adopt policies for the opening and closing of schools and  | 
| 18 | fix uniform dates.; however, Beginning with the 2007-2008 school  | 
| 19 | year, the opening date of the school year for schools in the  | 
| 20 | district may not be earlier than 14 days before Labor Day each  | 
| 21 | year. However, beginning with the 2008-2009 school year, a  | 
| 22 | district school board may with a super majority vote after  | 
| 23 | holding at least two public meetings that begin no earlier than  | 
| 24 | 6 p.m. establish an earlier opening date for students that is no  | 
| 25 | earlier than the 7th day of August or a different opening date  | 
| 26 | for a school that operates on a year-round or extended calendar. |
