7 | of Florida, is amended to read: |
8 | 1012.225 Merit Award Program for Instructional Personnel |
9 | and School-Based Administrators.-- |
10 | (2) PAY SUPPLEMENTS STRUCTURE.--Merit Award Program plans |
11 | shall provide for the annual disbursement of merit-based pay |
12 | supplements to high-performing employees in the manner described |
13 | in this subsection. |
14 | (a) Each Merit Award Program plan must designate the top |
15 | instructional personnel and school-based administrators to be |
16 | outstanding performers and pay to each such employee who remains |
17 | employed by a Florida public school or who retired after |
18 | qualifying for the award, by September 1 of the following school |
19 | year, a merit-based pay supplement of at least 5 percent of the |
20 | average teacher's salary for that school district not to exceed |
21 | 10 percent of the average teacher's salary for that school |
22 | district. The amount of a merit award may not be based on length |
23 | of service or base salary. Pay supplements shall be funded from |
24 | moneys appropriated by the Legislature under this section and |
25 | from any additional funds that are designated by the district |
26 | for the Merit Award Program. School districts are not required |
27 | to implement this section unless the program is specifically |
28 | funded by the Legislature. By October 1 of each year, each |
29 | school district shall provide documentation to the Department of |
30 | Education concerning the expenditure of legislative |
31 | appropriations for merit-based pay, and shall refund undisbursed |
32 | appropriations to the department. If such undisbursed funds are |
33 | not remitted to the department by November 1, the department |
34 | shall withhold an equivalent amount from the district's |
35 | allocation of appropriations made under s. 1011.62. |
