3     Amendment to Amendment (709567) (with title amendment)
4Between line(s) 530 and 531 insert:
5     Section 10.  Paragraph (a) of subsection (2) of section
61012.225, Florida Statutes, as created by chapter 2007-3, Laws
7of Florida, is amended to read:
8     1012.225  Merit Award Program for Instructional Personnel
9and School-Based Administrators.--
10     (2)  PAY SUPPLEMENTS STRUCTURE.--Merit Award Program plans
11shall provide for the annual disbursement of merit-based pay
12supplements to high-performing employees in the manner described
13in this subsection.
14     (a)  Each Merit Award Program plan must designate the top
15instructional personnel and school-based administrators to be
16outstanding performers and pay to each such employee who remains
17employed by a Florida public school or who retired after
18qualifying for the award, by September 1 of the following school
19year, a merit-based pay supplement of at least 5 percent of the
20average teacher's salary for that school district not to exceed
2110 percent of the average teacher's salary for that school
22district. The amount of a merit award may not be based on length
23of service or base salary. Pay supplements shall be funded from
24moneys appropriated by the Legislature under this section and
25from any additional funds that are designated by the district
26for the Merit Award Program. School districts are not required
27to implement this section unless the program is specifically
28funded by the Legislature. By October 1 of each year, each
29school district shall provide documentation to the Department of
30Education concerning the expenditure of legislative
31appropriations for merit-based pay, and shall refund undisbursed
32appropriations to the department. If such undisbursed funds are
33not remitted to the department by November 1, the department
34shall withhold an equivalent amount from the district's
35allocation of appropriations made under s. 1011.62.
