11  The Committee on Education Pre-K - 12 Appropriations
12  (Constantine) recommended the following amendment:
13  
14         Senate Amendment (with title amendment) 
15         Delete everything after the enacting clause
16  
17  and insert:  
18         Section 1.  The Office of Program Policy Analysis and
19  Government Accountability shall conduct a study of exceptional
20  student education for in-state students placed in private
21  residential care facilities.
22         (1)  For purposes of this section, the term:
23         (a)  "Agency" means an entity in the executive branch
24  of state government.
25         (b)  "Exceptional student" means an exceptional student
26  with a disability as defined in s. 1003.01(3), Florida
27  Statutes, whose parent resides in Florida and who is referred
28  to or placed by an agency in a private residential care
29  facility.
30         (2)  In conducting the study required by this section,
31  the Office of Program Policy Analysis and Government

Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 2130 Barcode 582224 1 Accountability shall: 2 (a) Review and summarize federal and state law and 3 administrative rules relating to the requirements for 4 educational services for exceptional students. 5 (b) Identify the practices implemented by agencies and 6 district school boards for the provision of educational 7 services to exceptional students. Such identification shall 8 include, but is not limited to: 9 1. Agency practices, prior to referral or placement, 10 for notifying and consulting with the district school board 11 that is currently serving the exceptional student and the 12 district school board of the school district in which the 13 private residential care facility is located. 14 2. Agency and district school board practices for 15 allocating financial and other responsibilities associated 16 with the provision of educational services to an exceptional 17 student. 18 (3) A final report of the study shall be submitted to 19 the President of the Senate and the Speaker of the House of 20 Representatives by December 31, 2007. The final report shall 21 include an evaluation of the practices identified under 22 paragraph (2)(b) and recommendations for the improvement of 23 those practices. The recommendations shall include, but not be 24 limited to, proposed statutory changes that will ensure the 25 equitable allocation of agency and district school board 26 responsibilities related to the provision of educational 27 services to exceptional students. 28 Section 2.
