18 Section 1. Section 1009.701, Florida Statutes, is
19 amended to read:
20 1009.701 First Generation Matching Grant Program for
21 state universities.--
22 (1) The First Generation Matching Grant Program for
23 state universities is created to enable each state university
24 to provide donors with a matching grant incentive for
25 contributions that will create grant-based student financial
26 aid for undergraduate students who demonstrate financial need
27 and whose parents, as defined in s. 1009.21(1), have not
28 earned a baccalaureate or higher degree. In the case of any
29 individual who regularly resided with and received support
30 from only one parent, an individual whose only such parent did
31 not complete a baccalaureate or higher degree would also be

1 eligible.
2 (2) Funds appropriated by the Legislature for the
3 program shall be allocated by the Office of Student Financial
4 Assistance to match private contributions on a
5 dollar-for-dollar basis. Contributions made to a state
6 university and pledged for the purposes of this section are
7 eligible for state matching funds appropriated for this
8 program and are not eligible for any other state matching
9 grant program. Pledged contributions are not eligible for
10 matching prior to the actual collection of the total funds.
11 The Office of Student Financial Assistance shall reserve a
12 proportionate allocation of the total appropriated funds for
13 each state university on the basis of full-time equivalent
14 resident undergraduate enrollment. For the 2007-2008 fiscal
15 year, funds that remain unmatched as of December 1 shall be
16 reallocated to state universities that have remaining
17 unmatched private contributions for the program on the basis
18 of full-time equivalent resident undergraduate enrollment.
19 Beginning with the 2008-2009 fiscal year, funds that remain
20 unmatched as of August 1 shall be reallocated to state
21 universities that have remaining unmatched private
22 contributions for the program on the basis of full-time
23 equivalent resident undergraduate enrollment.
24 (3) Payment of the state matching grant shall be
25 transmitted to the president of each participating institution
26 or his or her representative in advance of the official
27 drop-add deadline as defined by the institution.
28 (4) Each participating state university shall
29 establish an application process, determine student
30 eligibility for initial and renewal awards in conformance with
31 subsection (5), identify the amount awarded to each recipient,

1 and notify recipients of the amount of their awards. A
2 university may award grants for summer-term enrollment if
3 funds are available. Grants for summer-term enrollment may be
4 used only at the institution awarding the grant. For the
5 purpose of this subsection, "summer-term enrollment" means
6 enrollment in the term at the end of the academic year which
7 is the period of time from one fall term to the next in which
8 a full-time student is expected to complete the equivalent of
9 two semesters, two trimesters, or three quarters.
10 (5) In order to be eligible to receive a grant
11 pursuant to this section, an applicant must:
12 (a) Be a resident for tuition purposes pursuant to s.
13 1009.21.
14 (b) Be a first-generation college student. For the
15 purposes of this section, a student is considered "first
16 generation" if neither of the student's parents, as defined in
17 s. 1009.21(1), earned a college degree at the baccalaureate
18 level or higher or, in the case of any individual who
19 regularly resided with and received support from only one
20 parent, if that parent did not earn a baccalaureate or higher
21 degree.
22 (c) Be accepted at a state university.
23 (d) Be enrolled for a minimum of six credit hours per
24 term as a degree-seeking undergraduate student.
25 (e) Have demonstrated financial need by completing the
26 Free Application for Federal Student Aid.
27 (f) Meet additional eligibility requirements as
28 established by the institution.
29 (6) The award amount shall be based on the student's
30 need assessment after any scholarship or grant aid, including,
31 but not limited to, a Pell Grant or a Bright Futures

1 Scholarship, has been applied. An award may not exceed the
2 institution's estimated annual cost of attendance for the
3 student to attend the institution.
4 (7) The eligibility status of each student to receive
5 a disbursement shall be determined by each institution as of
6 the end of its regular registration period, inclusive of a
7 drop-add period. An institution shall not be required to
8 reevaluate a student's eligibility status after this date for
9 purposes of changing eligibility determinations previously
10 made. Participating institutions shall verify the continued
11 eligibility of awarded students, provide for the disbursement
12 of funds to students, and comply with the department's
13 reporting requirements. Institutions shall certify to the
14 department, each academic term within 30 days after the end of
15 the regular registration period, the student's enrollment,
16 continued eligibility, and the award amount. Any balance at
17 the end of a fiscal year that has been disbursed to an
18 institution for this program shall remain at the institution
19 and shall be available only to provide grants for returning
20 and new awardees. Each participating institution shall report
21 to the Office of Student Financial Assistance by the date
22 established by the office the eligible students to whom grant
23 moneys are disbursed each academic term. Each institution
24 shall certify to the Office of Student Financial Assistance
25 the amount of funds disbursed to each student and shall remit
26 to the office any undisbursed advances by June 1 of each year.
27 (8) No later than November 15 July 1, each
28 participating institution shall annually report to the
29 Executive Office of the Governor, the President of the Senate,
30 the Speaker of the House of Representatives, and the Board of
31 Governors the eligibility requirements for recipients, the

1 aggregate demographics of recipients, the retention and
2 graduation rates of recipients, and a delineation of funds
3 awarded to recipients in the prior academic year.
4 (9) This section shall be implemented only as
5 specifically funded.
6 Section 2. Section 1009.702, Florida Statutes, is
7 created to read:
8 1009.702 First Generation Matching Grant Program for
9 community colleges.--
10 (1) The First Generation Matching Grant Program for

8 2008-2009 fiscal year, funds that remain unmatched as of
9 August 1 shall be reallocated to community colleges that have
10 remaining unmatched private contributions for the program on
11 the basis of full-time equivalent resident enrollment in
12 advanced and professional programs.

29 created to enable each private nonprofit college or university
30 eligible to participate in the William L. Boyd, IV, Florida
31 Resident Access Grant Program to provide donors with a

1 matching grant incentive for contributions that will create

26 equivalent resident undergraduate enrollment. Beginning with
