  1                      A bill to be entitled

  2         An act relating to local government funding;

  3         amending s. 218.21, F.S.; deleting a specific

  4         ending date for increases to guaranteed

  5         entitlements for certain municipalities that

  6         receive revenue sharing funds; amending s.

  7         318.18, F.S.; deleting a specific ending date

  8         for a surcharge imposed by certain local

  9         governments on penalties for noncriminal

10         infractions; providing an effective date.

11  

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Subsection (6) of section 218.21, Florida

15  Statutes, is amended to read:

16         218.21  Definitions.--As used in this part, the

17  following words and terms shall have the meanings ascribed

18  them in this section, except where the context clearly

19  indicates a different meaning:

20         (6)  "Guaranteed entitlement" means the amount of

21  revenue which must be shared with an eligible unit of local

22  government so that:

23         (a)  No eligible county shall receive less funds from

24  the Revenue Sharing Trust Fund for Counties in any fiscal year

25  than the amount received in the aggregate from the state in

26  fiscal year 1971-1972 under the provisions of the

27  then-existing s. 210.20(2)(c), tax on cigarettes; the

28  then-existing s. 323.16(4), road tax; and the then-existing s.

29  199.292(4), tax on intangible personal property.

30         (b)  No eligible municipality shall receive less funds

31  from the Revenue Sharing Trust Fund for Municipalities in any

 1  fiscal year than the aggregate amount it received from the

 2  state in fiscal year 1971-1972 under the provisions of the

 3  then-existing s. 210.20(2)(a), tax on cigarettes; the

 4  then-existing s. 323.16(3), road tax; and s. 206.605, tax on

 5  motor fuel. Any government exercising municipal powers under

 6  s. 6(f), Art. VIII of the State Constitution may not receive

 7  less than the aggregate amount it received from the Revenue

 8  Sharing Trust Fund for Municipalities in the preceding fiscal

 9  year, plus, through fiscal year 2008-2009, a percentage

10  increase in such amount equal to the percentage increase of

11  the Revenue Sharing Trust Fund for Municipalities for the

12  preceding fiscal year.

13         Section 2.  Subsection (14) of section 318.18, Florida

14  Statutes, is amended to read:

15         318.18  Amount of civil penalties.--The penalties

16  required for a noncriminal disposition pursuant to s. 318.14

17  are as follows:

18         (14)  In addition to any penalties imposed for

19  noncriminal traffic infractions under this chapter or imposed

20  for criminal violations listed in s. 318.17, any unit of local

21  government that is consolidated as provided by s. 9, Art. VIII

22  of the State Constitution of 1885, as preserved by s. 6(e),

23  Art. VIII of the State Constitution of 1968, and that is

24  granted the authority in the State Constitution to exercise

25  all the powers of a municipal corporation, and any unit of

26  local government operating under a home rule charter adopted

27  pursuant to ss. 10, 11, and 24, Art. VIII of the State

28  Constitution of 1885, as preserved by s. 6(e), Art. VIII of

29  the State Constitution of 1968, that is granted the authority

30  in the State Constitution to exercise all the powers conferred

31  now or hereafter by general law upon municipalities, may

 1  impose by ordinance a surcharge of up to $15 for any

 2  infraction or violation. Revenue from the surcharge shall be

 3  transferred to such unit of local government for the purpose

 4  of replacing fine revenue deposited into the clerk's fine and

 5  forfeiture fund under s. 142.01. The court may not waive this

 6  surcharge. Proceeds from the imposition of the surcharge

 7  authorized in this subsection shall not be used for the

 8  purpose of securing payment of the principal and interest on

 9  bonds. This subsection, and any surcharge imposed pursuant to

10  this subsection, shall stand repealed September 30, 2007.

11         Section 3.  This act shall take effect July 1, 2007.

      ending date for a surcharge on penalties for noncriminal
