2 An act relating to the Florida Retirement
3 System; amending s. 121.0515, F.S.; prescribing
4 conditions under which certain former law
5 enforcement officer members of the Special Risk
6 Class of the system who were retired for
7 disability may receive credit for time spent on
8 retirement for disability; providing
9 retroactive applicability; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (10) is added to section
15 121.0515, Florida Statutes, to read:
16 121.0515 Special risk membership.--
17 (10) REEMPLOYMENT OF CERTAIN DISABLED
18 MEMBERS.--Notwithstanding any other provision of law, this
19 subsection applies with respect to any person who was formerly
20 a member of the Special Risk Class, who qualified for
21 membership in the class by reason of being employed or holding
22 office as a certified law enforcement officer, and who entered
23 the status of retirement due to disability because of a
24 disability caused by a wound or injury received in the line of
25 duty. If such a person's wound or injury becomes rehabilitated
26 to the extent that the person is capable of performing the
27 duties of a law enforcement officer and the person returns to
28 work as a law enforcement officer who is a member of the
29 Special Risk Class, that person may earn credit in the class
30 for the time he or she was retired due to disability as
31 follows: the person shall receive special risk credit for the

1 time spent retired due to disability at the rate of 1 year of
2 credit for such time for each 2 years of time spent in the
3 Special Risk Class after reemployment. A person may not
4 receive more credit under this subsection than the amount of
5 time he or she was retired due to disability.
6 Section 2. This act shall take effect upon becoming a
7 law and apply retroactively to January 1, 1990.

10 SENATE SUMMARY
11 Provides that a former law enforcement officer member of
the Special Risk Class of the Florida Retirement System
12 who is retired for disability due to a wound or injury in
the line of duty and who resumes employment as a law
13 enforcement officer after rehabilitation may earn credit
for time spent on retirement for disability at the rate
14 of 1 year of credit for each 2 years worked. The
provision operates retroactively to January 1, 1990.
