  1                      A bill to be entitled

  2         An act relating to inland navigation districts;

  3         amending s. 374.975, F.S.; including the

  4         right-of-way and channel of the intracoastal

  5         waterway and other designated public navigation

  6         channels within certain exclusions from aquatic

  7         preserves; authorizing the districts to use

  8         state lands under water for certain purposes;

  9         amending s. 374.976, F.S.; adding nonmember

10         counties that contain any part of the

11         intracoastal waterway within their boundaries

12         to the list of governmental entities with which

13         a district can aid and cooperate; providing an

14         effective date.

16  Be It Enacted by the Legislature of the State of Florida:

17  

18         Section 1.  Subsection (1) of section 374.975, Florida

19  Statutes, is amended to read:

20         374.975  Inland navigation districts; legislative

21  intent.--

22         (1)  The Legislature hereby recognizes the continuing

23  need for inland navigation districts to undertake programs

24  necessary to accomplish the purposes of construction,

25  maintenance, and operation of Florida's inland waterways

26  pursuant to s. 107 of the federal River and Harbor Act of 1960

27  (33 U.S.C. s. 577). To accomplish the purposes of

28  construction, operation, and maintenance of inland waterways,

29  the right-of-way and channel of the intracoastal waterway and

30  any other public navigation channel designated by the district

31  are included within the exclusion in s. 258.40(2), and the

 1  navigation districts may use state lands under water which are

 2  necessary to accomplish the purposes of this chapter.

 3         Section 2.  Paragraph (c) of subsection (1) of section

 4  374.976, Florida Statutes, is amended to read:

 5         374.976  Authority to address impacts of waterway

 6  development projects.--

 7         (1)  Each inland navigation district is empowered and

 8  authorized to undertake programs intended to alleviate the

 9  problems associated with its waterway or waterways, including,

10  but not limited to, the following:

11         (c)  The district is authorized to aid and cooperate

12  with the Federal Government, the state, member counties,

13  nonmember counties within which any part of the intracoastal

14  waterway is located, and local governments within the district

15  in planning and carrying out public navigation, local and

16  regional anchorage management, beach renourishment, public

17  recreation, inlet management, environmental education, and

18  boating safety projects, directly related to the waterways.

19  The district is also authorized to enter into cooperative

20  agreements with the United States Army Corps of Engineers,

21  state, and member counties, and to covenant in any such

22  cooperative agreement to pay part of the costs of acquisition,

23  planning, development, construction, reconstruction,

24  extension, improvement, operation, and maintenance of such

25  projects.

26         Section 3.  This act shall take effect July 1, 2007.
