1 A bill to be entitled
2 An act relating to prisoners; authorizing any
3 nonprofit or public health care organization to
4 distribute sexual barrier protection devices to
5 prisoners in prisons; requiring the Department
6 of Corrections to develop a plan to properly
7 dispose of used sexual barrier protection
8 devices; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. (1) The Department of Corrections shall
13 allow any nonprofit or public health care organization to
14 distribute sexual barrier protection devices, such as condoms,
15 to prisoners. The health care organization is subject to all
16 laws and rules governing visitors to a correctional facility.
17 (2) The distribution of sexual barrier protection
18 devices is not a crime and is not deemed to encourage sexual
19 acts between prisoners.
20 (3) The Department of Corrections may not use
21 possession of a device distributed under subsection (1) as
22 evidence of illegal activity for purposes of administrative
23 sanctions.
24 (4) The Department of Corrections shall develop a plan
25 for disposing of used sexual barrier protection devices which
26 protects the anonymity of prisoners and the health of
27 correctional officers.
28 Section 2. This act shall take effect July 1, 2007.
