  1                      A bill to be entitled

  2         An act relating to implanted microchips;

  3         prohibiting the implanting of a microchip or

  4         similar monitoring device into a person without

  5         providing full disclosure regarding the device

  6         and obtaining the person's informed written

  7         consent; providing a penalty; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  It is a felony of the third degree,

13  punishable as provided in s. 775.082, s. 775.083, or s.

14  775.084, Florida Statutes, to knowingly implant a microchip or

15  similar monitoring device into a person without providing full

16  disclosure to that person regarding the use of the device and

17  obtaining the person's informed written consent.

18         Section 2.  This act shall take effect July 1, 2007.

21                          SENATE SUMMARY
