  1                      A bill to be entitled

  2         An act relating to accessible parking spaces;

  3         amending s. 553.5041, F.S.; providing for

  4         reservation of accessible parking spaces for

  5         persons who require extra space to exit from or

  6         enter a motor vehicle; requiring signage;

  7         requiring specific markings; providing a

  8         penalty; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (7) is added to section

13  553.5041, Florida Statutes, to read:

14         553.5041  Parking spaces for persons who have

15  disabilities.--

16         (7)(a)1.  If a facility has five or more accessible

17  parking spaces pursuant to this section, at least 20 percent

18  must be reserved for the temporary exclusive use of persons

19  who have disabled parking permits, who occupy a van or other

20  vehicle having an attached device to load or unload a

21  wheelchair, and who require extra space to deploy the mobility

22  device, lift, ramp, or other device to exit from or enter such

23  vehicle.

24         2.  In addition to any other signage requirements under

25  this section or ADAAG s. 4.30, such spaces must be posted with

26  a yellow sign that bears a wheelchair emblem and words stating

27  "VANS OR VEHICLES WITH ATTACHED WHEELCHAIR DEVICES" and

28  stating the penalty for illegal use of the space.

29         3.  The spaces must be marked to allow for entry and

30  exit from the passenger side of the vehicles.

 1         (b)  A person without a disabled parking permit who

 2  parks in a space in violation of paragraph (a) is subject to a

 3  fine of $250.

 4         Section 2.  This act shall take effect October 1, 2007.

 7                          SENATE SUMMARY

 8    Requires certain parking spaces for disabled persons to
      be limited to parking by persons who require extra space
 9    to use specialty devices to exit from or enter their
      vehicles. Provides a fine for violations.
