2 An act relating to electrical and alarm system
3 contracting; amending s. 489.503, F.S.;
4 deleting an exemption from regulation for
5 certain persons who are not employed by a
6 telecommunications company certified under ch.
7 364, F.S.; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (14) of section 489.503, Florida
12 Statutes, is amended to read:
13 489.503 Exemptions.--This part does not apply to:
14 (14)(a) The installation of, repair of, alteration of,
15 addition to, or design of electrical wiring, fixtures,
16 appliances, thermostats, apparatus, raceways, and conduit, or
17 any part thereof, when those items are for the purpose of
18 transmitting data, voice communications, or commands as part
19 of a cable television, community antenna television, or radio
20 distribution system. The scope of this exemption is limited to
21 electrical circuits and equipment governed by the applicable
22 provisions of Articles 725 (Classes 2 and 3 circuits only),
23 770, 800, 810, and 820 of the National Electrical Code,
24 current edition, or 47 C.F.R. part 68.
25 (b) The installation of, repair of, alteration of,
26 addition to, or design of electrical wiring, fixtures,
27 appliances, thermostats, apparatus, raceways, and conduit, or
28 any part thereof, when those items are for the purpose of
29 transmitting data, voice communications, or commands as part
30 of a system of telecommunications, including computers,
31 telephone customer premises equipment, or premises wiring. The

1 scope of this exemption is limited to electrical circuits and
2 equipment governed by the applicable provisions of Articles
3 725 (Classes 2 and 3 circuits only), 770, 800, 810, and 820 of
4 the National Electrical Code, current edition, or 47 C.F.R.
5 part 68. A company certified under chapter 364 is not
6 subject to any local ordinance that requires a permit for work
7 performed by its employees related to low voltage electrical
8 work, including related technical codes and regulations. The
9 exemption in this paragraph shall apply only if such work is
10 requested by the company's customer, is required in order to
11 complete phone service, is incidental to provision of
12 telecommunication service as required by chapter 364, and is
13 not the subject of a competitive bid. The definition of
14 "employee" established in subsection (1) applies to this
15 exemption and does not include subcontractors. Persons who
16 perform work governed by the applicable provisions of Articles
17 725 (Classes 2 and 3 circuits only), 770, 800, 810, and 820 of
18 the National Electric Code, current edition, or 47 C.F.R. part
19 68 who are not employed by a company certified under chapter
20 364 must be certified pursuant to this part.
21 Section 2. This act shall take effect July 1, 2007.
