1 A bill to be entitled
2 An act relating to voting systems; amending s.
3 101.5606, F.S.; providing an additional
4 requirement for Department of State approval of
5 certain voting systems; requiring production of
6 a paper record meeting specified criteria;
7 requiring preservation of and access to such a
8 record; providing for use of such record in a
9 recount of certain elections; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsection (16) is added to section
15 101.5606, Florida Statutes, to read:
16 101.5606 Requirements for approval of systems.--No
17 electronic or electromechanical voting system shall be
18 approved by the Department of State unless it is so
19 constructed that:
20 (16) It produces a voter-verifiable paper record that
21 is suitable for a manual audit and is equivalent or superior
22 to the paper record of a paper ballot box system such that the
23 voting system, at minimum:
24 (a) Produces a permanent paper record, each individual
25 paper record of which is made available for inspection and
26 verification by the voter at the time the vote is cast and
27 preserved within the polling place in the manner in which all
28 other paper ballots are preserved within the polling place on
29 election day for later use in any manual audit.
30 (b) Provides the voter with an opportunity to correct
31 any error made by the system before the permanent record is

1 preserved for use in any manual audit. The voter-verified
2 paper record produced under this subsection shall be available
3 as an official record pursuant to chapter 119 and shall be the
4 official record used for any recount conducted with respect to
5 any election in which the system is used.
6 Section 2. This act shall take effect July 1, 2007.
