2 An act relating to the Department of Health;
3 amending s. 20.43, F.S.; deleting the
4 designation of Secretary of Health and
5 including the designation of State Surgeon
6 General as the head of the Department of
7 Health; providing requirements for the
8 position; providing duties for the State
9 Surgeon General; conforming references;
10 amending s. 381.0605, F.S.; clarifying that the
11 Surgeon General referred to in s. 381.0605,
12 F.S., is the Surgeon General of the United
13 States; requiring the Division of Statutory
14 Revision of the Office of Legislative Services
15 to change references to the Secretary of Health
16 to the Surgeon General within the Florida
17 Statutes; providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Subsections (2), (5), and (6) of section
22 20.43, Florida Statutes, are amended to read:
23 20.43 Department of Health.--There is created a
24 Department of Health.
25 (2)(a) The head of the Department of Health is the
26 State Surgeon General Secretary of Health and State Health
27 Officer. The State Surgeon General secretary must be a
28 physician licensed under chapter 458 or chapter 459 who has
29 advanced training or extensive experience in public health
30 administration. The State Surgeon General secretary is
31 appointed by the Governor subject to confirmation by the

1 Senate. The State Surgeon General secretary serves at the
2 pleasure of the Governor. The State Surgeon General shall
3 serve as the leading voice on wellness and disease-prevention
4 efforts and will focus on advocating healthy lifestyles,
5 developing public health policy, and building collaborative
6 partnerships with schools, businesses, health care
7 practitioners, community-based organizations, and public and
8 private institutions in order to promote health literacy and
9 optimum quality of life for all Floridians. The State Surgeon
10 General shall serve as a leading voice in addressing needs
11 concerning access to health care in this state and shall focus
12 on assessing and addressing the adequacy of the physician and
13 health professional workforce in meeting the health care needs
14 of this state's residents and visitors.
15 (b) The Officer of Women's Health Strategy is
16 established within the Department of Health and shall report
17 directly to the State Surgeon General secretary.
18 (5) The department shall plan and administer its
19 public health programs through its county health departments
20 and may, for administrative purposes and efficient service
21 delivery, establish up to 15 service areas to carry out such
22 duties as may be prescribed by the State Surgeon General
23 secretary. The boundaries of the service areas shall be the
24 same as, or combinations of, the service districts of the
25 Department of Children and Family Services established in s.
26 20.19 and, to the extent practicable, shall take into
27 consideration the boundaries of the jobs and education
28 regional boards.
29 (6) The State Surgeon General secretary and division
30 directors are authorized to appoint ad hoc advisory committees
31 as necessary. The issue or problem that the ad hoc committee

1 shall address, and the timeframe within which the committee is
2 to complete its work, shall be specified at the time the
3 committee is appointed. Ad hoc advisory committees shall
4 include representatives of groups or entities affected by the
5 issue or problem that the committee is asked to examine.
6 Members of ad hoc advisory committees shall receive no
7 compensation, but may, within existing departmental resources,
8 receive reimbursement for travel expenses as provided in s.
9 112.061.
10 Section 2. Subsection (2) of section 381.0605, Florida
11 Statutes, is amended to read:
12 381.0605 Survey of state hospital facilities; Agency
13 for Health Care Administration.--
14 (2) The Governor is authorized to provide for carrying
15 out such purposes in accordance with the standards prescribed
16 by the Surgeon General of the United States.
17 Section 3. The Division of Statutory Revision of the
18 Office of Legislative Services shall change "Secretary of
19 Health" or "Secretary of the Department of Health" to "State
20 Surgeon General" and change "secretary," with respect to that
21 department, to "State Surgeon General" wherever the same
22 appears in Florida Statutes.
23 Section 4. This act shall take effect July 1, 2007.

28 The committee substitute no longer deletes references to the
State Health Officer in the Florida Statutes. The bill revises
29 the duties of the State Surgeon General and removes provision
Uninsured Health within the Department of Health.
