  1                      A bill to be entitled

  2         An act relating to contractor regulation;

  3         amending s. 489.105, F.S.; defining the term

  4         "local enforcement board"; amending s. 489.113,

  5         F.S.; providing for such boards to exercise the

  6         same regulatory authority over certified

  7         contractors as that of local construction

  8         regulation boards; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (20) is added to section

13  489.105, Florida Statutes, to read:

14         489.105  Definitions.--As used in this part:

15         (20)  "Local enforcement board" means a local board

16  that exercises disciplinary control and oversight over locally

17  licensed contractors pursuant to s. 489.131(10).

18         Section 2.  Paragraph (b) of subsection (4) of section

19  489.113, Florida Statutes, is amended to read:

20         489.113  Qualifications for practice; restrictions.--

21         (4)

22         (b)  Notwithstanding the provisions of paragraph (a), a

23  local construction regulation board or local enforcement board

24  may deny, suspend, or revoke the authority of a certified

25  contractor to obtain a building permit or limit such authority

26  to obtaining a permit or permits with specific conditions, if

27  the local construction regulation board or local enforcement

28  board has found such contractor, through the public hearing

29  process, to be guilty of fraud or a willful building code

30  violation within the county or municipality that the local

31  construction regulation board or local enforcement board

 1  represents or if the respective local construction regulation

 2  board has proof that such contractor, through the public

 3  hearing process, has been found guilty in another county or

 4  municipality within the past 12 months, of fraud or a willful

 5  building code violation and finds, after providing notice of

 6  an opportunity to be heard to the contractor, that such fraud

 7  or violation would have been fraud or a violation if committed

 8  in the county or municipality that the respective local

 9  construction board represents. Notification of and information

10  concerning such permit denial shall be submitted to the

11  department within 15 days after the local construction

12  regulation board or local enforcement board decides to deny

13  the permit.

14         Section 3.  This act shall take effect July 1, 2007.
