1 A bill to be entitled
2 An act relating to funeral establishments;
3 creating s. 497.3801, F.S.; requiring that
4 certain establishments within the funeral
5 industry in the state be capable of operating
6 their refrigeration equipment by using an
7 alternate power source for a specified period
8 by a certain date; providing requirements with
9 respect to the operation of such equipment
10 following a major disaster; providing
11 requirements with respect to inspection of such
12 equipment; requiring newly constructed or
13 substantially renovated establishments within
14 the funeral industry to be capable of operation
15 using an alternate power source; defining the
16 term "substantially renovated"; requiring that
17 alternative power equipment be periodically
18 tested; providing an effective date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Section 497.3801, Florida Statutes, is
23 created to read:
24 497.3801 Alternate generated power capacity for
25 certain establishments in the funeral industry.--
26 (1) By June 1, 2008, the following establishments must
27 be capable of operating their space and equipment used for the
28 storage and refrigeration of dead human bodies by using an
29 alternate generated power source for a minimum of 168 hours:
30 (a) A refrigeration facility, as defined in s.
31 497.005.

1 (b) A direct disposal establishment, as defined in s.
2 497.005, which maintains space and equipment for the storage
3 and refrigeration of dead human bodies.
4 (c) A funeral establishment, as defined in s. 497.005,
5 which maintains space and equipment for the storage and
6 refrigeration of dead human bodies.
7 (d) A crematory that maintains space and equipment for
8 the storage and refrigeration of dead human bodies.
9 (2) Pending a postdisaster examination of the
10 establishment by the direct disposer, embalmer, cremator,
11 funeral director, or owner of an establishment specified in
12 subsection (1) to determine any extenuating damage that would
13 render it unsafe to use, the establishment must have such
14 alternate generated power source available for operation no
15 later than 24 hours after a major disaster as defined in s.
16 252.34. Installation of appropriate wiring, including a
17 transfer switch, shall be performed by a certified electrical
18 contractor. Each establishment that is subject to subsection
19 (1) must keep a copy of the documentation of such installation
20 on site or at its corporate headquarters. In addition, such
21 establishment must keep a written statement attesting to the
22 periodic testing and ensured operational capacity of the
23 equipment. The required documents must be made available, upon
24 request, to the Division of Emergency Management and the
25 director of the county emergency management agency.
26 (3) Each newly constructed or substantially renovated
27 establishment that is subject to subsection (1), for which a
28 certificate of occupancy is issued on or after July 1, 2007,
29 must be prewired with an appropriate transfer switch and
30 capable of operating all equipment used for refrigeration of
31 dead human bodies using an alternate generated power source.

1 As used in this subsection, the term "substantially renovated"
2 means a renovation that results in an increase of greater than
3 50 percent in the assessed value of the establishment that is
4 subject to subsection (1). The local building inspector shall
5 check the equipment and operations of the establishment in the
6 normal inspection process before issuing a certificate of
7 occupancy. Each newly constructed or substantially renovated
8 establishment that is subject to subsection (1) must keep a
9 copy of the certificate of occupancy on site or at its
10 corporate headquarters. In addition, such establishment must
11 keep a written statement attesting to the periodic testing of
12 and ensured operational capability of the equipment. The
13 required documents must be made available, upon request, to
14 the Division of Emergency Management and the director of the
15 county emergency management agency.
16 Section 2. This act shall take effect upon becoming a
17 law.

21 Requires that certain establishments within the funeral
