2 An act relating to the Myakka River; amending
3 s. 258.501, F.S.; requiring that the Myakka
4 River Management Coordinating Council provide a
5 report recommending the expansion of the
6 Florida Wild and Scenic River Designation for
7 the entire Myakka River to the Governor, the
8 President of the Senate, and the Speaker of the
9 House of Representatives; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (7) of section 258.501, Florida
15 Statutes, is amended to read:
16 258.501 Myakka River; wild and scenic segment.--
17 (7) MANAGEMENT COORDINATING COUNCIL.--
18 (a) Upon designation, the department shall create a
19 permanent council to provide interagency and intergovernmental
20 coordination in the management of the river. The coordinating
21 council shall be composed of one representative appointed from
22 each of the following: the department, the Department of
23 Transportation, the Fish and Wildlife Conservation Commission,
24 the Department of Community Affairs, the Division of Forestry
25 of the Department of Agriculture and Consumer Services, the
26 Division of Historical Resources of the Department of State,
27 the Tampa Bay Regional Planning Council, the Southwest Florida
28 Water Management District, the Southwest Florida Regional
29 Planning Council, Manatee County, Sarasota County, Charlotte
30 County, the City of Sarasota, the City of North Port,

1 agricultural interests, environmental organizations, and any
2 others deemed advisable by the department.
3 (b) The coordinating council shall review and make
4 recommendations on all proposals for amendments or
5 modifications to this section and to the permanent management
6 plan, as well as on other matters which may be brought before
7 the council by the department, any local government, or any
8 member of the council, and shall render its nonbinding
9 advisory opinion to the Southwest Florida Water Management
10 District, the department, and affected local governments.
11 (c) The Myakka River Management Coordinating Council
12 shall provide a report, which includes recommendations
13 concerning the potential expansion of the Florida Wild and
14 Scenic River designation to the entire Myakka River. The
15 report shall include, at a minimum, a description of the
16 extent of the Myakka River area, which may be covered under
17 the designation, and any recommendations or concerns of
18 affected parties or other interests. During the development of
19 the report, at least one public hearing shall be held in the
20 affected area of Manatee County. The report shall be provided
21 to the Governor, the President of the Senate, and the Speaker
22 of the House of Representatives no later than January 1, 2008.
23 (d)(c) The council may adopt bylaws to provide for
24 election of such officers as it deems necessary, removal of
25 officers for just cause, meetings, quorum, procedures, and
26 other such matters as its members may deem advisable in the
27 conduct of its business. Such bylaws shall be approved by the
28 department.
29 (e)(d) Such professional staff as the coordinating
30 council may require shall be provided by the department.

1 Section 2. This act shall take effect upon becoming a
2 law.

7 Revises the Myakka River Wild and Scenic Designation and
Preservation Act requiring the Myakka River Management
8 Coordination Council to provide a report of recommendations
for the potential expansion of the designation to encompass
9 the entire Myakka River. The report shall be provided to the
Governor, the President of the Senate, and the Speaker of the
10 House of Representatives no later than January 1, 2008.
