12  following amendment to amendment (481236):

14         Senate Amendment (with title amendment) 
15         On page 20, between lines 14 and 15,

17  insert:  
18         Section 4.  Section 400.9936, Florida Statutes, is
19  created to read:
20         400.9936  Diagnostic testing facility.--
21         (1)  As used in this section, the term "diagnostic
22  testing facility" means a clinic licensed under s. 400.991
23  which:
24         (a)  Performs the technical component of magnetic
25  resonance imaging, computed tomography, or positron emission
26  tomography;
27         (b)  Provides the professional component of such
28  services through an employee or independent contractor;
29         (c)  Is located in a fixed facility;
30         (d)  Is accredited by the Joint Commission on
31  Accreditation of Healthcare Organizations and the American

Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. SB 2354 Barcode 080680 1 College of Radiology; and 2 (e) Does not directly or indirectly provide any 3 services to patients other than magnetic resonance imaging, 4 computed tomography, or positron emission tomography. 5 (2) Only a person having a financial interest in a 6 diagnostic testing facility, including the chief executive 7 officer, president, chief operations officer, vice president, 8 or other corporate officer, is subject to the background 9 screening requirements of part X of chapter 400. 10 (3)(a) The medical director or clinic director of a 11 clinic, in addition to the requirements of s. 400.9935, may 12 serve in that capacity only for a maximum of five clinics in a 13 diagnostic testing facility. In addition, a medical director 14 or clinic director in a diagnostic testing facility may not 15 supervise a clinic that is located more than 300 miles from 16 any other clinic supervised by that medical director or clinic 17 director. 18 (b) The agency may waive the requirements of this 19 subsection upon a showing of good cause if it determines that 20 the medical director or clinic director can adequately satisfy 21 the other requirements of s. 400.9935. 22 (c) Any variance approved by the agency for a 23 diagnostic testing facility as of May 1, 2007, remains in 24 effect for the term of the approved variance. 25 26 (Redesignate subsequent sections.) 27 28 29 ================ T I T L E A M E N D M E N T =============== 30 And the title is amended as follows: 31 On page 22, line 31, after the first semicolon, 2 10:48 AM 04/19/07 s2354.hr02.02b
