11  The Committee on Criminal Justice (Crist) recommended the
12  following amendment:
13  
14         Senate Amendment 
15         On page 2, line 28, through page 3, line 23, delete
16  those lines
17  
18  and insert:  keep legal private property within their motor
19  vehicles, out of sight particularly such property as is
20  necessary for or incidental to their exercise of other
21  constitutional rights, and that these rights are not abrogated
22  by virtue of a citizen becoming a customer, employee, or
23  invitee of a business entity. It is the finding of the
24  Legislature that a citizen's lawful possession,
25  transportation, and secure keeping of certain private property
26  within his or her motor vehicle is essential to the exercise
27  of fundamental constitutional rights, including freedom of
28  speech, freedom of association, the free exercise of religion,
29  and the right to keep and bear arms.  The Legislature finds
30  that securing individual private property rights is essential.
31  The Legislature further finds that no citizen is or should be

Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. SB 2356 Barcode 672076 1 required to waive or abrogate his or her right to possess and 2 securely keep such constitutionally significant private 3 property locked within his or her motor vehicle by virtue of 4 becoming a customer, employee, or invitee of any employer or 5 business establishment within the state. 6 (2) PROHIBITED ACTS.--No public or private entity may 7 violate the constitutional rights of any customer, employee, 8 or invitee as provided in paragraphs (a)-(e): 9 (a) No public or private entity may prohibit any 10 customer, employee, or invitee from possessing any personal 11 private property that is a legal product when such product is 12 lawfully possessed and locked inside or locked to a private 13 motor vehicle, out of sight, in a parking lot and when the 14 customer, 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 2 5:57 PM 03/27/07 s2356.cj12.00b
