1 A bill to be entitled
2 An act relating to the registration of
3 unlicensed osteopathic physicians; amending s.
4 459.021, F.S.; providing for an annual fee for
5 registration renewal; increasing the penalty
6 and clarifying provisions regarding actions
7 that constitute a misdemeanor with respect to
8 willful misconduct by a hospital administrator;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsections (1), (2), and (5) of section
14 459.021, Florida Statutes, are amended to read:
15 459.021 Registration of resident physicians, interns,
16 and fellows; list of hospital employees; penalty.--
17 (1) Any person who holds a degree of Doctor of
18 Osteopathic Medicine from a college of osteopathic medicine
19 recognized and approved by the American Osteopathic
20 Association who desires to practice as a resident physician,
21 assistant resident physician, house physician, intern, or
22 fellow in fellowship training which leads to subspecialty
23 board certification in this state, or any person desiring to
24 practice as a resident physician, assistant resident
25 physician, house physician, intern, or fellow in fellowship
26 training in a teaching hospital in this state as defined in s.
27 408.07(45) or s. 395.805(2), who does not hold an active
28 license issued under this chapter shall apply to the
29 department to be registered, on an application provided by the
30 department, prior to within 30 days of commencing such a

1 training program and shall remit a fee not to exceed $300 as
2 set by the board.
3 (2) Any person required to be registered under this
4 section shall renew such registration annually and shall remit
5 a renewal fee, which may not exceed $300 as set by the board.
6 Such registration shall be terminated upon the registrant's
7 receipt of an active license issued under this chapter. A No
8 person may not shall be registered under this section for an
9 aggregate of more than 5 years, unless additional years are
10 approved by the board.
11 (5) It is a misdemeanor of the first second degree,
12 punishable as provided in s. 775.082 or s. 775.083, for any
13 hospital or teaching hospital, and also for the
14 superintendent, administrator, and other person or persons
15 having administrative authority in such hospital to willfully:
16 (a) To Employ the services in such hospital of any
17 person listed in subsection (3), unless such person is
18 registered with the department under the law or the holder of
19 a license to practice osteopathic medicine under this chapter.
20 (b) To Fail to furnish to the department the list and
21 information required by subsection (3).
22 Section 2. This act shall take effect October 1, 2007.
