  1                      A bill to be entitled

  2         An act relating to the use of cellular

  3         telephones; prohibiting the use of a cellular

  4         telephone while operating a motor vehicle;

  5         providing exemptions; providing a penalty;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Cellular telephones.--

11         (1)  A person may not operate a motor vehicle on the

12  highways of this state while dialing or sending a telephone

13  call or text message on a cellular telephone or while

14  listening to or speaking on a cellular telephone. As used in

15  this section, the term "cellular telephone" has the same

16  meaning as in s. 817.4821, Florida Statutes.

17         (2)  This section does not prohibit the use of a

18  cellular telephone for safety or law enforcement purposes if

19  the use is approved by the Department of Highway Safety and

20  Motor Vehicles.

21         (3)  A violation of this section is a noncriminal

22  traffic infraction, punishable as a nonmoving violation as

23  provided in chapter 318, Florida Statutes.

24         Section 2.  This act shall take effect July 1, 2007.
