1 A bill to be entitled
2 An act relating to state universities;
3 directing the State Board of Education to
4 approve an agreement under which Florida
5 Atlantic University will sublease land for the
6 construction of a community-university
7 affiliated teaching hospital; providing a
8 finding of public purpose; providing for the
9 President or Chief Executive Officer of the
10 university to serve on the hospital's board of
11 directors; authorizing the university to grant
12 the hospital an option to purchase the land
13 subject to the sublease; providing a contingent
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. (1) The State Board of Education shall
19 approve an agreement between Florida Atlantic University and
20 Boca Raton Community Hospital, Inc., a Florida not-for-profit
21 corporation, for the sublease of land on the Boca Raton campus
22 of Florida Atlantic University, including the construction by
23 the lessee, at the lessee's cost and expense, of a
24 community-university affiliated teaching hospital and
25 ancillary facilities, together with all furnishings,
26 equipment, and other chattels used in the operation of a
27 hospital. The public-private partnership set forth in the
28 sublease between the university and the lessee for the
29 development and construction of a community-university
30 affiliated teaching hospital, which shall serve as the primary
31 teaching hospital for a major regional academic medical

1 program located at the Boca Raton campus of Florida Atlantic
2 University, constitutes a public purpose and meets the medical
3 needs as well as the academic medical education needs of the
4 State of Florida. For purposes of this section, "lessee" means
5 Boca Raton Community Hospital, Inc., a Florida not-for-profit
6 corporation.
7 (2) For purposes of this section, all materials and
8 meetings related to the undergraduate medical and graduate
9 medical education programs of the university shall become
10 subject to Section 24, Article I of the State Constitution and
11 ss. 119.07(1) and 286.011, Florida Statutes.
12 (3) Either the President of Florida Atlantic
13 University or the Chief Executive Officer of Florida Atlantic
14 University shall serve on the board of directors of the
15 lessee.
16 (4) The Florida Atlantic University Board of Trustees
17 may, with the approval of the Board of Trustees of the
18 Internal Improvement Trust Fund, grant the lessee an option to
19 purchase the land subject to the sublease. The compensation
20 paid by the lessee for the fee simple interest in the land and
21 the leasehold interest shall be payable to the university.
22 Section 2. This act shall take effect July 1, 2007, if
23 Senate Bill _____ or similar legislation granting an exemption
24 from public-records requirements for records associated with
25 the lease described in this act and an exemption from
26 public-meetings requirements for meetings between the lessor
27 and lessee described in this act is adopted at the same
28 session of the Legislature, or an extension thereof, and
29 becomes law.

2 SENATE SUMMARY
3 Directs the State Board of Education to approve a
sublease of land at the Boca Raton campus of Florida
4 Atlantic University to Boca Raton Community Hospital for
the sublessee to construct a community-university
5 affiliated teaching hospital. The university president or
chief executive officer will serve on the hospital board
6 of directors. The university may, with the approval of
the Board of Trustees of the Internal Improvement Trust
7 Fund, grant the hospital an option to buy the subleased
land.
