| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Subsection (16) of section 175.032, Florida |
| 13 | Statutes, is amended to read: |
| 14 | 175.032 Definitions.--For any municipality, special fire |
| 15 | control district, chapter plan, local law municipality, local |
| 16 | law special fire control district, or local law plan under this |
| 17 | chapter, the following words and phrases have the following |
| 18 | meanings: |
| 19 | (16) "Special fire control district" means a special |
| 20 | district, as defined in s. 189.403(1), established for the |
| 21 | purposes of extinguishing fires, protecting life, and protecting |
| 22 | property within the incorporated or unincorporated portions of |
| 23 | any county or combination of counties, or within any combination |
| 24 | of incorporated and unincorporated portions of any county or |
| 25 | combination of counties. The term includes community development |
| 26 | districts providing fire suppression and related services |
| 27 | pursuant to s. 190.012(2)(b). The term does not include any |
| 28 | dependent or independent special district, as defined in s. |
| 29 | 189.403(2) and (3), respectively, the employees of which are |
| 30 | members of the Florida Retirement System pursuant to s. |
| 31 | 121.051(1) or (2). |
| 32 | Section 2. Subsection (17) is added to section 190.011, |
| 33 | Florida Statutes, to read: |
| 34 | 190.011 General powers.--The district shall have, and the |
| 35 | board may exercise, the following powers: |
| 36 | (17) To assess and impose the state excise tax authorized |
| 37 | under s. 175.101, if exercising the powers permitted under s. |
| 38 | 190.012(2)(b). |
| 39 | Section 3. This act shall take effect July 1, 2007. |
