  1                      A bill to be entitled

  2         An act relating to self-service storage space;

  3         creating s. 83.8061, F.S.; prohibiting the

  4         owner of a self-service storage facility or

  5         self-contained storage unit from enforcing a

  6         lien against certain tenants on overseas active

  7         duty in the United States military; providing

  8         an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Section 83.8061, Florida Statutes, is

13  created to read:

14         83.8061  Enforcement of liens against servicemembers on

15  active duty prohibited.--The owner of a self-service storage

16  facility or a self-contained storage unit may not pursue any

17  action to enforce a lien under this part against a tenant who

18  is a servicemember, as defined in s. 250.01, while the tenant

19  is serving outside the United States on active duty, as

20  defined in s. 250.01, or for 90 days after the tenant

21  completes such overseas active duty, if the tenant has given

22  written notice regarding the overseas active duty to the

23  owner.

24         Section 2.  This act shall take effect July 1, 2007.

27                          SENATE SUMMARY

28    Prohibits the owner of a self-service storage facility or
      self-contained storage unit from attempting to enforce a
29    lien against a tenant who is a military servicemember on
      active duty outside the United States or for 90 days
30    after such overseas active duty is completed, if such
      tenant has given the owner written notice of such duty.
