12 following amendment:

14 Senate Amendment (with title amendment)
15 Delete everything after the resolving clause

17 and insert:
18 That the following amendment to Section 4 of Article IX
19 of the State Constitution is agreed to and shall be submitted
20 to the electors of this state for approval or rejection at the
21 next general election or at an earlier special election
22 specifically authorized by law for that purpose:
23 ARTICLE IX
24 EDUCATION
25 SECTION 4. School districts; school boards.--
26 (a) Each county shall constitute a school district;
27 provided, two or more contiguous counties, upon vote of the
28 electors of each county pursuant to law, may be combined into
29 one school district. In each school district there shall be a
30 school board composed of five or more members chosen by vote
31 of the electors in a nonpartisan election for appropriately

1 staggered terms of four years, as provided by law.
2 (b) The school board shall operate, control and
3 supervise all free public schools within the school district
4 and determine the rate of school district taxes within the
5 limits prescribed herein. Two or more school districts may
6 operate and finance joint educational programs.
7 (c) Upon vote of the electors of the county pursuant
8 to general law, a school district may be divided into two or
9 more school districts, each having no fewer than 25,000
10 students. A school district is not required to exercise its
11 option to divide the school district pursuant to this
12 subsection. However, general law authorizing division of a
13 school district shall provide for more than one method by
14 which the question of dividing the school district into two or
15 more school districts is placed on the ballot, including an
16 initiative by the electors of the county. School district
17 taxes for the school districts created pursuant to this
18 subsection shall be imposed countywide and distributed to the
19 school districts in an equitable and nondiscriminatory manner
20 as provided by general law. The rate of school district taxes
21 shall be determined by a board consisting of an equal number
22 of school board members from each school district in the
23 county as provided by general law.
24 BE IT FURTHER RESOLVED that the following statement be
25 placed on the ballot:
26 CONSTITUTIONAL AMENDMENT
27 ARTICLE IX, SECTION 4
28 AUTHORIZING THE DIVISION OF A SCHOOL DISTRICT INTO TWO
29 OR MORE SCHOOL DISTRICTS.--Proposing an amendment to the State
30 Constitution to provide that school districts may be divided
31 into two or more school districts, each having no fewer than

1 25,000 students, upon approval by vote of the electors of the
2 county pursuant to general law; to provide that a school
3 district is not required to exercise its option to divide the
4 school district; to require that general law authorizing
5 division of a school district shall provide for more than one
6 method by which the question of dividing the school district
7 into two or more school districts may be placed on the ballot,
8 including an initiative by the electors of the county; to
9 provide that school district taxes shall be imposed countywide
10 and distributed to the school districts in an equitable and
