  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         1013.6401, F.S.; creating the Increased

  4         Utilization Account within the Public Education

  5         Capital Outlay and Debt Service Trust Fund

  6         within the Department of Education; providing

  7         purposes; providing for future review and

  8         termination or re-creation of the account;

  9         providing a contingent effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 1013.6401, Florida Statutes, is

14  created to read:

15         1013.6401  Public Education Capital Outlay and Debt

16  Service Trust Fund; Increased Utilization Account.--

17         (1)  The Increased Utilization Account is created in

18  the Public Education Capital Outlay and Debt Service Trust

19  Fund in the Department of Education. Moneys in the account

20  shall be used for the purposes described in s. 1013.64(8).

21         (2)  In accordance with s. 19(f)(2), Art. III of the

22  State Constitution, the Increased Utilization Account shall,

23  unless terminated sooner, be terminated on July 1, 2011.

24  Before its scheduled termination, the account shall be

25  reviewed as provided in s. 215.3206(1) and (2).

26         Section 2.  This act shall take effect July 1, 2007, if

27  Senate Bill _____ or similar legislation amending s. 1013.64,

28  Florida Statutes, to provide for distributions of funds to

29  school districts for schools that have increased their FTE

30  capacity through alternative or nontraditional calendars is

 1  adopted in the same legislative session, or an extension

 2  thereof, and becomes law.

 6    Creates the Increased Utilization Account within the
