1 A bill to be entitled
2 An act relating to construction contracting;
3 amending s. 489.111, F.S.; revising the
4 requirements for licensure by examination;
5 requiring an applicant to provide a set of
6 fingerprints and reimbursement for the expense
7 of a criminal background check; requiring a
8 convicted felon to have had his or her civil
9 rights restored in order to be licensed;
10 amending s. 489.115, F.S.; revising and
11 clarifying criteria for certification or
12 registration; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsection (2) of section 489.111, Florida
17 Statutes, is amended to read:
18 489.111 Licensure by examination.--
19 (2) A person is shall be eligible for licensure by
20 examination if the person:
21 (a) Is 18 years of age;
22 (b) Is of good moral character; and
23 (c) Has submitted to the department a set of
24 fingerprints on a form specified by the department and payment
25 equal to the cost incurred by the department for the criminal
26 background check of the applicant;
27 (d) Has had his or her civil rights restored if they
28 have previously been lost due to a felony conviction; and
29 (e)(c) Meets eligibility requirements according to one
30 of the following criteria:

1 1. Has received a baccalaureate degree from an
2 accredited 4-year college in the appropriate field of
3 engineering, architecture, or building construction and has 1
4 year of proven experience in the category in which the person
5 seeks to qualify. For the purpose of this part, a minimum of
6 2,000 person-hours shall be used in determining full-time
7 equivalency.
8 2. Has a total of at least 4 years of active
9 experience as a worker who has learned the trade by serving an
10 apprenticeship as a skilled worker who is able to command the
11 rate of a mechanic in the particular trade or as a foreman who
12 is in charge of a group of workers and usually is responsible
13 to a superintendent or a contractor or his or her equivalent,
14 provided, however, that at least 1 year of active experience
15 shall be as a foreman.
16 3. Has a combination of not less than 1 year of
17 experience as a foreman and not less than 3 years of credits
18 for any accredited college-level courses; has a combination of
19 not less than 1 year of experience as a skilled worker, 1 year
20 of experience as a foreman, and not less than 2 years of
21 credits for any accredited college-level courses; or has a
22 combination of not less than 2 years of experience as a
23 skilled worker, 1 year of experience as a foreman, and not
24 less than 1 year of credits for any accredited college-level
25 courses. All junior college or community college-level courses
26 shall be considered accredited college-level courses.
27 4.a. An active certified residential contractor is
28 eligible to take the building contractors' examination if he
29 or she possesses a minimum of 3 years of proven experience in
30 the classification in which he or she is certified.

1 b. An active certified residential contractor is
2 eligible to take the general contractors' examination if he or
3 she possesses a minimum of 4 years of proven experience in the
4 classification in which he or she is certified.
5 c. An active certified building contractor is eligible
6 to take the general contractors' examination if he or she
7 possesses a minimum of 4 years of proven experience in the
8 classification in which he or she is certified.
9 5.a. An active certified air-conditioning Class C
10 contractor is eligible to take the air-conditioning Class B
11 contractors' examination if he or she possesses a minimum of 3
12 years of proven experience in the classification in which he
13 or she is certified.
14 b. An active certified air-conditioning Class C
15 contractor is eligible to take the air-conditioning Class A
16 contractors' examination if he or she possesses a minimum of 4
17 years of proven experience in the classification in which he
18 or she is certified.
19 c. An active certified air-conditioning Class B
20 contractor is eligible to take the air-conditioning Class A
21 contractors' examination if he or she possesses a minimum of 1
22 year of proven experience in the classification in which he or
23 she is certified.
24 6.a. An active certified swimming pool servicing
25 contractor is eligible to take the residential swimming pool
26 contractors' examination if he or she possesses a minimum of 3
27 years of proven experience in the classification in which he
28 or she is certified.
29 b. An active certified swimming pool servicing
30 contractor is eligible to take the swimming pool commercial
31 contractors' examination if he or she possesses a minimum of 4

1 years of proven experience in the classification in which he
2 or she is certified.
3 c. An active certified residential swimming pool
4 contractor is eligible to take the commercial swimming pool
5 contractors' examination if he or she possesses a minimum of 1
6 year of proven experience in the classification in which he or
7 she is certified.
8 d. An applicant is eligible to take the swimming
9 pool/spa servicing contractors' examination if he or she has
10 satisfactorily completed 60 hours of instruction in courses
11 related to the scope of work covered by that license and
12 approved by the Construction Industry Licensing Board by rule
13 and has at least 1 year of proven experience related to the
14 scope of work of such a contractor.
15 Section 2. Subsection (2) of section 489.115, Florida
16 Statutes, is amended to read:
17 489.115 Certification and registration; endorsement;
18 reciprocity; renewals; continuing education.--
19 (2)(a) The department shall issue a certificate or
20 registration to each person who meets the qualifications in s.
21 489.111 and this section and who is qualified by the board and
22 upon receipt of the original license fee.
23 (b) Certification allows the certificateholder to
24 engage in contracting only for the type of work covered by the
25 certificate and only while the certificate is on active
26 status.
27 Section 3. This act shall take effect July 1, 2007.
