3 amending s. 408.0361, F.S.; revising provisions
4 relating to compliance with requirements
5 imposed on providers of diagnostic cardiac
6 catheterization services; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (b) of subsection (3) of section
12 408.0361, Florida Statutes, is amended to read:
13 408.0361 Cardiology services and burn unit
14 licensure.--
15 (3) In establishing rules for adult interventional
16 cardiology services, the agency shall include provisions that
17 allow for:
18 (b) For a hospital seeking a Level I program,
19 demonstration that:,
20 1. For the most recent 12-month period as reported to
21 the agency, it has provided a minimum of 300 adult inpatient
22 and outpatient diagnostic cardiac catheterizations or, for the
23 most recent 12-month period, has discharged or transferred at
24 least 300 inpatients with the principal diagnosis of ischemic
25 heart disease and that it has a formalized, written transfer
26 agreement with a hospital that has a Level II program,
27 including written transport protocols to ensure safe and
28 efficient transfer of a patient within 60 minutes; or
29 2. If the hospital seeking a Level I program will be a
30 newly licensed hospital established pursuant to a certificate
31 of need in a physical location previously licensed and

1 operated as a hospital, the former hospital provided a minimum
2 of 300 adult inpatient and outpatient diagnostic cardiac
3 catheterizations for the most recent 12-month period as
4 reported to the agency and the newly licensed hospital has a
5 formalized, written transfer agreement with a hospital that
6 has a Level II program, including written transport protocols
7 to ensure safe and efficient transfer of a patient within 60
8 minutes. The newly licensed hospital must certify that it can
9 provide a minimum of 300 adult inpatient and outpatient
10 diagnostic cardiac catheterizations by the end of its first
11 year of operation. If the newly licensed hospital fails to
12 provide 300 adult inpatient and outpatient diagnostic cardiac
13 catheterizations by the end of the first year of operation,
14 its license shall be modified to delete Level I services. In
15 order to ensure continuity of available services, the holder
16 of a certificate of need for a newly licensed hospital that
17 meets the requirements of this subparagraph may apply for
18 certification of Level I program status before taking
19 possession of the physical location of the former hospital.
20 The effective date of Level I program status shall be
21 concurrent with the effective date of the newly issued
22 hospital license.
23 Section 2. This act shall take effect July 1, 2007.
