1 A bill to be entitled
2 An act relating to certificates of need;
3 amending s. 408.0361, F.S.; revising provisions
4 relating to compliance with certain criteria
5 imposed on any hospital seeking to provide
6 diagnostic cardiac catheterization Level II
7 services; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Paragraph (c) of subsection (3) of section
12 408.0361, Florida Statutes, is amended to read:
13 408.0361 Cardiology services and burn unit
14 licensure.--
15 (3) In establishing rules for adult interventional
16 cardiology services, the agency shall include provisions that
17 allow for:
18 (c)1. For a hospital seeking a Level II program,
19 demonstration that, for the most recent 12-month period as
20 reported to the agency, it has performed a minimum of 1,100
21 adult inpatient and outpatient cardiac catheterizations, of
22 which at least 400 must be therapeutic catheterizations, or,
23 for the most recent 12-month period, has discharged at least
24 800 patients having with the principal diagnosis of ischemic
25 heart disease.
26 2. Alternatively, a hospital may be licensed as a
27 Level II program if:
28 a. The hospital is a newly licensed hospital that has
29 a certificate of need and is physically located in a building
30 that was previously licensed and operated as a hospital under
31 a Level II program license;

1 b. The hospital certifies that it presently meets and
2 will continuously maintain the minimum licensure requirements
3 that may be adopted by the agency governing adult open-heart
4 programs, including the most current guidelines of the
5 American College of Cardiology and American Heart Association
6 Guidelines for adult open-heart programs;
7 c. The hospital certifies that it possesses and will
8 maintain sufficient appropriate equipment and health care
9 personnel to ensure quality and safety for its patients;
10 d. The hospital certifies that it will maintain
11 appropriate times of operation and protocols to ensure
12 availability and appropriate referrals in the event of
13 emergency;
14 e. The hospital certifies that at least 300 inpatients
15 having the principal diagnosis of ischemic heart disease were
16 discharged from the former hospital for the most recent
17 12-month period as reported to the agency;
18 f. The former hospital was a general acute care
19 hospital that was in operation for 3 years or more; and
20 g. The former hospital performed at least 300 combined
21 inpatient and outpatient diagnostic cardiac catheterization
22 procedures during the most recent 12-month period, as reported
23 to the agency.
24 3. If the hospital fails to meet the criteria for a
25 Level II open-heart program or fails to conduct at least 300
26 surgeries each year by the end of its 3rd year of operation,
27 the hospital must show cause why its license as a Level II
28 program should not be revoked.
29 4. In order to ensure continuity of available
30 services, the holder of a certificate of need for a newly
31 licensed hospital that meets the requirements of this

1 paragraph may apply for certification as a Level II program
2 before taking possession of the physical location of the
3 former hospital. The effective date of certification of a
4 Level II program is the same as the date the hospital license
5 is issued.
6 Section 2. This act shall take effect July 1, 2007.

11 The committee substitute allows a hospital to become licensed
as a Level II program for adult interventional cardiology
12 services upon meeting certain criteria. If the hospital fails
to meet the criteria for a Level II program or fails to
13 conduct at least 300 surgeries each year by the end of its
third year, the hospital must show cause why its license as a
14 Level II program should not be revoked.
