  1                      A bill to be entitled

  2         An act relating to certificates of need;

  3         amending s. 408.0361, F.S.; revising provisions

  4         applicable to hospitals seeking certification

  5         as Level I programs; providing criteria for

  6         certification to provide certain Level I

  7         cardiology services; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Present subsections (4), (5), and (6) of

13  section 408.0361, Florida Statutes, are renumbered as

14  subsections (5), (6), and (7), respectively, and a new

15  subsection (4) is added to that section, to read:

16         408.0361  Cardiology services and burn unit

17  licensure.--

18         (4)  In order to ensure continuity of available

19  services, the holder of a certificate of need for a newly

20  licensed hospital that meets the requirements of this

21  subsection may apply for and shall be granted Level I program

22  status regardless of whether rules relating to Level I

23  programs have been adopted. To qualify for a Level I program

24  under this subsection, a hospital seeking a Level I program

25  must be a newly licensed hospital established pursuant to a

26  certificate of need in a physical location previously licensed

27  and operated as a hospital, the former hospital must have

28  provided a minimum of 300 adult inpatient and outpatient

29  diagnostic cardiac catheterizations for the most recent

30  12-month period as reported to the agency, and the newly

31  licensed hospital must have a formalized, written transfer

 1  agreement with a hospital that has a Level II program,

 2  including written transport protocols to ensure safe and

 3  efficient transfer of a patient within 60 minutes. A hospital

 4  meeting the requirements of this subsection may apply for

 5  certification of Level I program status before taking

 6  possession of the physical location of the former hospital,

 7  and the effective date of Level I program status shall be

 8  concurrent with the effective date of the newly issued

 9  hospital license.

10         Section 2.  This act shall take effect July 1, 2007.
