12 following amendment:

15 On page 83, between lines 20 and 21,

17 insert:
18 Section 42. Section 197.572, Florida Statutes, is
19 amended to read:
20 197.572 Easements for conservation purposes, or for
21 public service purposes or for drainage or ingress and egress
22 survive tax sales and deeds.--When any lands are sold for the
23 nonpayment of taxes, or any tax certificate is issued thereon
24 by a governmental unit or agency or pursuant to any tax lien
25 foreclosure proceeding, the title to the lands shall continue
26 to be subject to any easement for conservation purposes as
27 provided in s. 704.06 or telephone, telegraph, pipeline, power
28 transmission, or other public service purpose and shall
29 continue to be subject to any easement for the purposes of
30 drainage or of ingress and egress to and from other land. The
31 easement and the rights of the owner of it shall survive and

1 be enforceable after the execution, delivery, and recording of
2 a tax deed, a master's deed, or a clerk's certificate of title
3 pursuant to foreclosure of a tax deed, tax certificate, or tax
4 lien, to the same extent as though the land had been conveyed
5 by voluntary deed. The easement must be evidenced by written
6 instrument recorded in the office of the clerk of the circuit
7 court in the county where such land is located before the
8 recording of such tax deed or master's deed, or, if not
9 recorded, an easement for a public service purpose must be
10 evidenced by wires, poles, or other visible occupation, an
11 easement for drainage must be evidenced by a waterway, water
12 bed, or other visible occupation, and an easement for the
13 purpose of ingress and egress must be evidenced by a road or
14 other visible occupation to be entitled to the benefit of this
15 section; however, this shall apply only to tax deeds issued
16 after the effective date of this act.
