11 The Committee on Finance and Tax (Haridopolos) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 52, line 30, through
16 page 55, line 12, delete those lines
17
18 and insert:
19 Section 26. (1) In coordination with financial
20 institutions doing business in this state, the Department of
21 Revenue may design and implement a pilot program for
22 identifying account holders against whose property the
23 department has issued a warrant or filed a judgment lien
24 certificate. Under the program, the department may enter into
25 agreements with financial institutions, as defined in s.
26 409.25657, Florida Statutes, to develop and operate a data
27 match system that uses automated data exchanges to the maximum
28 extent feasible.
29 (2) A financial institution is not liable and is not
30 required to provide notice to its customers:
31 (a) For disclosure of any information for purposes of

1 this program; or
2 (b) For any other action taken in good faith to
3 participate in this program.
4 (3) The department may request from a financial
5 institution information and assistance to enable the
6 department to design and implement the program. The department
7 shall administer this program in conjunction with s.
8 409.25657, Florida Statutes, in order to reduce the burden of
9 participation on financial institutions. The department shall
10 pay a reasonable fee to participating financial institutions
11 for participating in this program, but the fee may not exceed
12 the actual costs incurred by such financial institution. All
13 financial records obtained pursuant to this section may be
14 disclosed only for the purpose of administering and enforcing
15 the tax laws of this state. The department may engage in
16 collection activities based upon the information received
17 under this program.
18 (4) The department shall report its findings and
19 recommendations on the feasibility of permanently establishing
20 the data match program to the Government Efficiency and
21 Accountability Council of the House of Representatives and the
22 Committee on Finance and Tax of the Senate on or before
23 January 1, 2008.
