13         Senate Amendment (with title amendment) 
14         On page 75, line 6, through
15            page 77, line 9, delete those lines
16  
17  and insert:  
18         Section 39.  Paragraph (b) of subsection (1) of section
19  443.141, Florida Statutes, is amended to read:
20         443.141  Collection of contributions and
21  reimbursements.--
22         (1)  PAST DUE CONTRIBUTIONS AND REIMBURSEMENTS.--
23         (b)  Penalty for delinquent reports.--
24         1.  An employing unit that fails to file any report
25  required by the Agency for Workforce Innovation or its tax
26  collection service provider, in accordance with rules for
27  administering this chapter, shall pay to the tax collection
28  service provider for each delinquent report the sum of $25 for
29  each 30 days or fraction thereof that the employing unit is
30  delinquent, unless the agency or its service provider,
31  whichever required the report, finds that the employing unit

The 2 agency or its service provider may assess penalties only 3 through the date of the issuance of the final assessment 4 notice. However, additional penalties accrue if the delinquent 5 report is subsequently filed. 6 2. Sums collected as penalties under subparagraph 1. 7 must be deposited in the Special Employment Security 8 Administration Trust Fund. 9 3. The penalty and interest for a delinquent report 10 may be waived when the penalty or interest is inequitable.
