1 A bill to be entitled
2 An act relating to state and local government
3 spending; providing definitions; requiring the
4 Department of State to create and manage a
5 website disclosing certain spending by state
6 and local governmental entities under certain
7 contracts; providing for free access to the
8 website; providing requirements concerning the
9 content of the website; providing an exemption
10 for public records that are not subject to
11 disclosure; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Transparency of spending by state and local
16 government.--
17 (1) As used in this section, the term:
18 (a) "Contract" means a legally binding agreement
19 between a governmental entity and a person which requires the
20 entity to pay the person $5,000 or more. The term includes an
21 agreement that would require a total payment of $5,000 or more
22 if each term extension that the agreement authorizes were
23 instituted.
24 (b) "Expenditure" means a payment that a governmental
25 entity makes to a person under a contract.
26 (c) "Governmental entity" means a state agency, a
27 political subdivision, a corporation created by and acting on
28 behalf of a state agency or political subdivision, or a taxing
29 authority created by a state agency or political subdivision.
30 (d) "Person" means a corporation, association,
31 partnership, limited liability company, limited liability

1 partnership, sole proprietorship, or any other legal business
2 entity, whether for profit or nonprofit. The term excludes an
3 individual, an employee of a governmental entity, or an
4 employee of the Federal Government.
5 (2) The Department of State shall create and manage a
6 website that is searchable and that a person who has Internet
7 access can use without paying a fee. The website must list,
8 for each quarter of each calendar year, each expenditure made
9 on or after July 1, 2007, by a governmental entity to a person
10 under a contract by:
11 (a) Name of the governmental entity making the
12 expenditure;
13 (b) Name of the person receiving the expenditure;
14 (c) Date of the expenditure;
15 (d) Amount of the expenditure; and
16 (e) Purpose of the expenditure.

18 The website also must state the name of each party to a
19 contract for which the website lists an expenditure and
20 provide an electronic copy of the contract.
21 (3) This section does not require that any public
22 record that is exempt from inspection or copying under chapter
23 119, Florida Statutes, be listed on a website.
24 Section 2. This act shall take effect July 1, 2007.
