11 The Committee on Banking and Insurance (Bennett) recommended
12 the following amendment:

14 Senate Amendment
15 On page 4, lines 5 through 11, delete those lines
16
17 and insert: 4. Has implemented a business plan. The business
18 plan must:
19 a. Provide for the initial and continuing education of
20 the natural persons exempted by this paragraph which is
21 commensurate with their duties and responsibilities and shall,
22 as appropriate, cover such topics as:
23 (I) The Equal Credit Opportunity Act;
24 (II) The federal and Florida Fair Housing Acts;
25 (III) The Home Mortgage Disclosure Act of 1975;
26 (IV) The Community Reinvestment Act;
27 (V) The Americans with Disabilities Act;
28 (VI) The Real Estate Settlement Procedures Act of
29 1974;
30 (VII) The Truth-In-Lending Act;
31 (VIII) Regulation Z of the Board of Governors of the

1 Federal Reserve System;
2 (IX) Florida and company fair lending laws and
3 policies;
4 (X) Federal and Florida laws and company policies with
5 respect to consumer privacy protection;
6 (XI) Federal and Florida laws and company policies
7 with respect to information security;
8 (XII) Federal and Florida laws and company policies
9 with respect to recordkeeping requirements;
10 (XIII) Florida laws with respect to prohibited
11 practices;
12 (XIV) Complaint handling procedures;
13 (XV) Disclosures;
14 (XVI) Advertising;
15 (XVII) Background checks;
16 (XVIII) Examinations;
17 (XIX) Violations and enforcement; and
18 (XX) Mortgage fraud recognition and prevention.
19 b. Provide for the handling of consumer complaints
20 related to the natural persons exempted by this paragraph.
21 c. Provide for the supervision of the mortgage-related
22 activities of the natural persons exempted by this paragraph.
23 d. Be reasonably designed to ensure that the natural
24 persons exempted by this paragraph deliver all disclosures
25 required by federal and Florida law.
26 e. Be reasonably designed to prevent and detect
27 violations of this chapter.
