13         Senate Amendment (with directory and title amendments) 
14         On page 2, between lines 23 and 24,
15  
16  insert:  
17         (10)  This section does not confer civil liability upon
18  a business for acts of persons who are not employees or agents
19  of the business if the business has acted reasonably to
20  prevent violations of this section which occur on the premises
21  of the business.
22         (a)  At a minimum, reasonable prevention includes:
23         1.  A written policy that is enforced to deter such
24  persons from violating this section;
25         2.  Security measures to detect such persons who may be
26  attempting to violated this section;
27         3.  Inspecting restrooms, changing rooms, and other
28  areas of the premises prone to having hidden imaging devices
29  at least once per day to discover the existence of imaging
30  devices;
31         4.  Electronically monitoring the premises at least

Posting of warning signs in all areas prone to 4 hidden imaging devises which state that the premises is 5 subject to special security measures, frequent electronic 6 monitoring, and frequent inspections designed to detect 7 violations of this section and to deter persons from violating 8 this section; and 9 6. Training sessions that inform employees or agents 10 of the provisions of this section and of the standards and 11 procedures in place to detect and deter persons from violating 12 this section. 13 (b) The facts and results of each visual inspection 14 and electronic monitoring session shall be documented in a 15 written or electronic log, identifying each area inspected and 16 monitored and the name and position of the employee or agent 17 conducting the inspection or monitoring.
