  1                      A bill to be entitled

  2         An act relating to county operating budgets;

  3         limiting annual increases in county operating

  4         budgets; providing criteria; providing an

  5         exception; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8  

  9         Section 1.  Notwithstanding any other provision of

10  general or local law, annual increases in a county's operating

11  budget shall not exceed the percentage increase in the

12  county's population, as determined by the Office of Economic

13  and Demographic Research's latest "Florida Estimates of

14  Population," plus the percentage change in the Consumer Price

15  Index as provided in s. 193.155(1)(b), Florida Statutes. This

16  limitation on annual increases in the county's operating

17  budget may be overcome by a finding of necessity due to

18  emergency or critical need approved by a super majority vote

19  of the county commission.

20         Section 2.  This act shall take effect July 1, 2007.
