  1                      A bill to be entitled

  2         An act relating to regulation of smoking;

  3         amending s. 386.209, F.S.; authorizing

  4         municipalities and counties to regulate smoking

  5         at certain venues; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8  

  9         Section 1.  Section 386.209, Florida Statutes, is

10  amended to read:

11         386.209  Regulation of smoking preempted to

12  state.--This part expressly preempts regulation of smoking to

13  the state and supersedes any municipal or county ordinance on

14  the subject, with the exception of a municipal or county

15  ordinance that regulates smoking at public parks, athletic

16  facilities, or other venues where persons under the age of 18

17  may be present.

18         Section 2.  This act shall take effect July 1, 2007.
