1 A bill to be entitled
2 An act relating to patient brokering; amending
3 s. 817.505, F.S.; providing that the statutory
4 provision prohibiting patient brokering is not
5 applicable to a physician's referral of a
6 person to an attorney or an attorney's referral
7 of a person to a physician; providing that such
8 referral is not payment or compensation;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (j) is added to subsection (3) of
14 section 817.505, Florida Statutes, to read:
15 817.505 Patient brokering prohibited; exceptions;
16 penalties.--
17 (3) This section shall not apply to:
18 (j) The referral of any person by a physician licensed
19 under chapter 458, chapter 459, chapter 460, or chapter 461,
20 or by a group practice as defined in s. 456.053(3), to an
21 attorney, or the referral of any person by an attorney to a
22 physician licensed under chapter 458, chapter 459, chapter
23 460, or chapter 461, or to a group practice as defined in s.
24 456.053(3). Such referral does not constitute payment or
25 compensation.
26 Section 2. This act shall take effect upon becoming a
27 law.
