  1                      A bill to be entitled

  2         An act relating to public transit providers;

  3         creating s. 341.065, F.S.; requiring such

  4         providers to give restroom breaks to their

  5         drivers or operators of public conveyances;

  6         providing an exception; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Section 341.065, Florida Statutes, is

12  created to read:

13         341.065  Public transit providers; required restroom

14  breaks.--

15         (1)  A public transit provider must give each driver or

16  operator of a public conveyance in the transit system a paid

17  restroom break of not less than 10 minutes for each 4-hour

18  period or major part of such period worked.

19         (2)  However, a public transit provider may provide

20  appropriate restroom break periods, pursuant to a collective

21  bargaining agreement, which differ from those required in this

22  section.

23         Section 2.  This act shall take effect July 1, 2007.
